Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Lookmark website (http://lookmark.io) and our apps for any devices and platforms (hereinafter collectively called "Lookmark") operated by Heybox AB ("us", "we", or "our").

Your access to and use of Lookmark is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all who wish to access or use Lookmark.

By accessing or using Lookmark you agree to be bound by these Terms. If you disagree with any part of the Terms then you do not have permission to access Lookmark.

About Lookmark

Lookmark is a service developed and provided by Heybox AB. The service is available in the iOS App Store as "Lookmark", in the Google Chrome Web Store as "Lookmark" and in the Safari Extension Gallery as "Lookmark".

The purpose of Lookmark is to make it easier for our users to download media content such as apps, movies, books, music etc. that they discover on their mobile device or when browsing the web on their computer.

Your account

When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with Lookmark or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content in our sole discretion.

You can at any time choose to cancel/end your account at your convenience.

Content

For purposes of these Terms, the term "Content" includes, without limitation, information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through Lookmark. For the purposes of this Agreement, "Content" also includes all User Content (as defined below).

All Content added, created, uploaded, submitted, distributed, or posted to Lookmark by users (collectively "User Content") is the sole responsibility of the person who originated such User Content. You represent that (i) all User Content provided by you is in compliance with all applicable laws, including those related to the intellectual property rights of third parties, (ii) you either are the sole and exclusive owner of your User Content or you have all the rights necessary to grant us the rights to such User Content under these Terms of Service, and (iii) there are no payments due of any kind to a third party through the use of your User Content through Lookmark. You acknowledge that all Content, including User Content, accessed by you using Lookmark is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. We do not guarantee that any Content you access on or through Lookmark is or will continue to be accurate.

We do not guarantee that any Content will be made available on Lookmark. We reserve the right to, but do not have any obligation to, (i) remove, edit or modify any Content in our sole discretion, at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if we are concerned that you may have violated these Terms), or for no reason at all and (ii) remove or block any Content from Lookmark.

Communications

By creating an account on Lookmark (an "Account"), you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Lookmark Plus

Lookmark Plus is a subscription to extra features provided as an in-app purchase in the iOS app. When the subscription fee is paid you get access to Lookmark Plus during the time your subscription is valid.

You may at any time cancel your subscription, in which case your subscription will still be valid for the subscription time you have already paid for.

The payment is handled by Apple through the App Store, and the only way to cancel your subscription is through the use of Apple's services. All payments handled by Apple can only be refunded by Apple and with Apple’s consent. If you would like to contact Apple, please click here.

We reserve the right to change the subscription fees from time to time.

Intellectual property

All rights in and to Lookmark, including any trademarks, service marks, trade names and copyrighted content (collectively "Intellectual Property") presented within Lookmark are the property of Lookmark and/or third parties. You agree not to use Intellectual Property for any other purposes except for your use of Lookmark, unless required otherwise by applicable mandatory law.

Disclaimer and limitation of liability

You use Lookmark at your own risk. Lookmark is provided "AS IS", without any warranties, and we do not warrant that Lookmark and availability thereof will be uninterrupted or error free. We do not assume any responsibility for errors or omissions in the information or software or other documents, including User Content, which are referenced by or linked to. References or links to third parties' websites are provided "AS IS" without warranty of any kind, either expressed or implied.

In no event shall Lookmark be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.

Updates and upgrades

We are not obligated to maintain or support Lookmark, or to provide you with updates, upgrades or services related thereto. You acknowledge that we may from time to time in our sole discretion issue updates or upgrades to Lookmark. You agree that the terms and conditions of these Terms of Service will apply to all such updates or upgrades.

Third party services

Lookmark may permit you to link to other websites, applications, services or resources on the Internet, and other websites, applications, services or resources may contain links to Lookmark.

Lookmark may also permit you to link your account to other services for sharing what you find, or finding other Lookmark users among your friends. Such other services may include Facebook, Twitter, App.net, Tumblr, LinkedIn, Pinboard, and Evernote. When you access third party resources on the Internet, you do so at your own risk. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply our endorsement or any association between their operators and us.

You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or resource.

Termination

We may terminate your access to all or any part of Lookmark at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your membership. Any fees paid hereunder are non-refundable. All provisions of these Terms of Service, which by their nature should survive termination shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Miscellaneous

For the sake of clarity, we don’t undertake the obligation to monitor the User Content.

You are not entitled to assign your rights and/or obligations under these Terms or use of Lookmark to any third party without our prior written consent. Lookmark is entitled to assign its rights and/or obligations under these Terms.

Governing law

The laws of Sweden, except for its conflicts of laws principles, govern these Terms and the use of Lookmark. The public Swedish courts, whereby the District Court of Stockholm shall be the court of first instance, shall resolve all claims arising out of or relating to these Terms or Lookmark.

Privacy

Our Privacy Policy explains what personal information we collect about you when you use Lookmark (http://lookmark.io/privacy).

Changes

These Terms of Service are subject to change by Lookmark at any time, effective upon posting in Lookmark, and your use of Lookmark after such posting will represent acceptance by you of such changes. When accessing Lookmark and creating an account you consent to have this Agreement provided to you in electronic form.
